1. Introduction
1.1 These Terms and Conditions (“Terms”) govern all memberships, access, use, and participation in BAT FIT CRAZY PTY LTD facilities, services, and products, including but not limited to: our 24/7 access gym, online coaching, café, supplement sales, and apparel store.
1.2 By becoming a member, purchasing a product or service, or otherwise using our facilities, you agree to be bound by these Terms.
1.3 BAT FIT CRAZY reserves the right to amend these Terms at any time. Continued use of our facilities constitutes acceptance of any amended Terms.

2. Membership and Access
2.1 Membership is subject to approval by BAT FIT CRAZY.
2.2 All upfront memberships and membership fees are strictly non-refundable, including in cases of cancellation, change of mind, or non-usage.
2.3 Members must be at least 12 years of age.
2.4 Members under 18 years must have a parent/legal guardian sign the waiver and Terms on their behalf.
2.5 Members aged 12–13 must always be accompanied by a parent/legal guardian who is a current member.
2.6 Members aged 14–15 may only access during staffed hours or with their parent/legal guardian outside staffed hours. The parent/legal guardian must also be a member.
2.7 Members aged 16–17 may access the facility 24/7 with written parental/guardian consent.
2.8 All members must have their own individual access FOB. Access is personal and non-transferable.

3. Access Control and Security
3.1 No Tailgating: Each member must enter the premises using their own FOB. Members must not allow another person to enter with their FOB, open doors for another person, or otherwise bypass access systems.
3.2 If a member forgets their FOB, they must report to the office during staffed hours to be manually signed in.
3.3 Breaches:

• First offence: $50 fee charged to the account of the responsible member.

• Repeated offences: May result in immediate suspension or permanent termination of membership without refund.
  3.4 Members are responsible for ensuring doors close securely behind them.
  3.5 BAT FIT CRAZY reserves the right to monitor entry logs and CCTV footage for compliance and safety.

4. Gym Facilities
4.1 Members use all equipment and facilities at their own risk.
4.2 Members must follow all posted rules, staff instructions, and safety requirements.
4.3 Members must return equipment after use and maintain cleanliness and hygiene, including wiping down equipment.
4.4 Damage to equipment or facilities caused by negligence or misuse will be charged to the responsible member.
4.5 BAT FIT CRAZY maintains equipment regularly but makes no guarantee that equipment will be available or free of faults at all times.

5. Health and Safety
5.1 Members must not use the facilities if under the influence of alcohol, drugs, or any substance that impairs judgment or physical ability.
5.2 Members must disclose any pre-existing injuries or health conditions to their medical provider prior to commencing exercise. BAT FIT CRAZY is not responsible for verifying medical fitness.
5.3 Emergency procedures, including the location of duress buttons and exits, must be familiarised and followed at all times.

6. Online Coaching
6.1 Online coaching is provided for general fitness guidance only and does not substitute medical, nutritional, or physiotherapy advice.
6.2 BAT FIT CRAZY accepts no liability for injury, illness, or loss arising from participation in online coaching programs.

7. Café
7.1 Food and beverages are consumed at the customer’s own risk.
7.2 BAT FIT CRAZY accepts no responsibility for allergic reactions or intolerances. It is the customer’s responsibility to check ingredient information before purchase.

8. Supplements
8.1 Supplements, including but not limited to protein powders, pre-workouts, amino acids, and vitamins, are sold on site for general use only and do not constitute medical or nutritional advice.
8.2 BAT FIT CRAZY makes no representations or warranties as to the suitability, efficacy, or safety of any supplement for your particular needs.
8.3 It is the customer’s responsibility to consult with a qualified healthcare professional before using any supplement, particularly if they are pregnant, breastfeeding, taking medication, or have any pre-existing medical condition.
8.4 Supplements are consumed entirely at the customer’s own risk.
8.5 All supplement sales are final. No refunds, returns, or exchanges will be provided except as required by Australian Consumer Law.
8.6 BAT FIT CRAZY accepts no liability for any illness, injury, or adverse reaction resulting from the purchase or consumption of supplements.

9. Apparel Store
9.1 All sales are final.
9.2 No refunds, exchanges, or returns will be provided except as required by Australian Consumer Law.

10. Payments
10.1 Memberships, including upfront memberships, joining fees, and coaching fees, are strictly non-refundable.
10.2 All fees must be paid in full and on time. Access may be suspended for non-payment.
10.3 BAT FIT CRAZY reserves the right to adjust fees and charges at any time with reasonable notice.

11. Cancellation and Termination
11.1 BAT FIT CRAZY reserves the right to cancel or suspend membership immediately for:

• Breach of these Terms, including tailgating or inappropriate behaviour.

• Misuse of equipment or facilities.

• Conduct that endangers staff, members, or property.
  11.2 Members may cancel after the minimum four-week term by providing written notice, but no refunds will be given.
  11.3 Termination for breach does not entitle the member to any refund of fees.

12. Liability
12.1 To the maximum extent permitted by law, BAT FIT CRAZY and its directors, staff, and contractors are not liable for any injury, loss, damage, theft, or property loss incurred while using our facilities or services.
12.2 Members acknowledge that participation in physical activity involves inherent risks.

13. Indemnity
13.1 Members indemnify BAT FIT CRAZY against all claims, costs, and damages arising from their actions, breaches, or negligence.

14. Governing Law
14.1 These Terms are governed by the laws of Queensland, Australia.

15. Waiver
15.1 All members (and their parent/legal guardian if under 18) must sign the Waiver and Release of Liability form prior to commencing membership.
